2) Acceptance of terms

By accessing this website or booking our services, you agree to be bound by these Terms and all applicable policies referenced herein (including our Privacy Policy and Refund Policy). If you do not agree, do not use the site or services.

3) Website use

• You may browse for personal, non-commercial purposes.
• You must not misuse the site, interfere with its security, or access non-public areas.
• Content is provided for general information; we may update, suspend, or discontinue the site at any time.

4) Intellectual property

All images, text, logos, and graphics are owned by or licensed to Meadow Crest Works and protected by copyright and other laws. You may not reproduce, distribute, modify, sell, or create derivative works without our prior written consent. Licensed client deliverables are governed by Section 8.

5) Booking & payment (services)

• Quotations: valid for the time stated in writing. Scope will specify date(s), location(s), deliverables, fees, and usage rights.
• Retainer: a non-refundable retainer may be required to secure a date; balance due per invoice terms.
• Rescheduling: subject to availability; fees may apply. See Section 10 and our Refund Policy.
• Expenses: client is responsible for agreed travel, accommodation, permits, and other costs.

6) Client responsibilities

• Provide accurate information, timely approvals, and necessary access/permissions.
• Ensure subjects and venues permit photography and any required model/property releases are arranged or authorized.
• Safety: you agree to reasonable safety rules on set/locations.

7) Our services and delivery

• Creative discretion: you engage us for our style and professional judgment; we do not guarantee specific shots unless expressly agreed.
• Post‑production: includes our standard color grading and light retouching; extensive manipulations may incur additional fees.
• Delivery: via online gallery or download link within an estimated timeframe communicated prior to the shoot.
• Archive: we are not obligated to retain raw files or galleries beyond a reasonable period unless otherwise agreed.

8) Licensing of deliverables

Upon full payment, we grant the client a non-exclusive, non-transferable license to use delivered images for the purposes specified in the agreement (e.g., personal use, editorial, brand marketing) and term/territory outlined therein. Unless otherwise stated, no rights to sell, sublicense, or use for unlawful/defamatory purposes are granted. We retain copyright and the right to use works for self‑promotion, awards, and portfolio, respecting privacy and any agreed embargo.

9) Model and property releases

Client is responsible for obtaining necessary permissions for identifiable persons or private locations, unless otherwise agreed in writing. We may request written releases for certain usages.

10) Cancellations, delays, force majeure

• Cancellations by client: retainers are non-refundable; additional fees may apply depending on notice and costs incurred.
• Rescheduling for weather/illness: parties will use reasonable efforts to find a new date; retainers may be transferred at our discretion.
• Force majeure: neither party is liable for events beyond reasonable control (e.g., severe weather, illness, strikes, power/network outages). Liability is limited to fees paid for undelivered services.

11) Warranties and disclaimers

The website and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including non-infringement, merchantability, and fitness for a particular purpose.

12) Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to these Terms, the site, or services shall not exceed the total amounts paid by you to us for the service giving rise to the claim in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. Nothing limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

13) Privacy & cookies

Your use of the site is also governed by our Privacy Policy. We use a consent banner to control optional analytics/personalization scripts.

15) Governing law & jurisdiction
